Why this statute does not apply to content hosted on r34tube.
Animation-only content policy
r34tube exclusively hosts animated, illustrated, and computer-generated content depicting fictional characters. The site does not produce, host, or knowingly distribute visual depictions of real persons engaged in sexually explicit conduct. Uploads suspected of depicting real persons are auto-quarantined on detection and removed where confirmed by a human moderator.
Fictional characters and age
All characters depicted on r34tube are fictional and are intended to be adults aged 18 or older. Material that depicts a fictional character who appears to be under 18, including aged-down or deliberately youthful depictions of otherwise adult characters, is prohibited regardless of the character being fictional.
This rule is enforced by automated moderation at upload time and by human review. Content that breaches it is removed and the uploader is subject to account action. This policy applies to every video on the site.
Why § 2257 does not apply
18 U.S.C. § 2257 and 28 C.F.R. § 75 impose record-keeping obligations on producers and secondary producers of visual depictions of actual sexually explicit conduct by real persons, as defined in 18 U.S.C. § 2256.
Virtual, animated, and computer-generated depictions fall outside the scope of the statute (see Ashcroft v. Free Speech Coalition, 535 U.S. 234 (2002)). Because r34tube hosts no content within the statute's scope, no record-keeping or custodian of records is required.
Reporting suspected violations
To report content suspected of depicting a real person under 18 years old, use the priority reporting form on the affected video page (select "CSAM" as the reason). The report auto-quarantines the video pending immediate human review.
To report other content depicting real persons that you believe was uploaded without consent, use the content removal form.
